Terms of use for Art on Shelf, operated by [FILL IN: operator, address]. Last updated [FILL IN: date].

1. What we do

Art on Shelf is software that lets sellers upload digital products, set a price and sell them through a link. Every sale is a contract between the buyer and the seller. Art on Shelf is not a party to it: the seller sets the price and the licence, the payment is made to the seller's own Stripe account, and the receipt is issued in the seller's name.

2. Seller responsibilities

Taxes. Sellers are the seller of record for their sales and are solely responsible for their own taxes, including income tax and any VAT or sales tax on their sales, and for registering where required. Art on Shelf does not calculate, collect or pay taxes on sellers' sales. Art on Shelf only invoices its own fees. [FILL IN: have a tax advisor confirm this model for EU VAT on digital products.]

Rights. Sellers may only sell content they own or are licensed to sell. They grant buyers the licence described on the product page and in the licence PDF.

Prohibited content. No illegal content, no content infringing third-party rights, no malware. We may remove products and suspend accounts that break these rules.

3. Fees

Free plan: 5% of each sale. Pro plan: €15 per month (VAT included) and 0% per sale. On every plan, card processing of 1.5% + €0.25 per sale. Fees are deducted automatically from each payment and shown before every sale in the product form and in Sales. Payouts to the seller's bank are free. On refunds the buyer receives the full price and fees are not returned. Chargeback fees charged by banks are covered by Art on Shelf. Pro renews monthly and can be cancelled at any time for the end of the period. Art on Shelf issues the seller a monthly invoice for its fees. There are no other costs.

4. Payouts

To take paid orders, sellers fill in the Get paid form once, which opens a Stripe account for them, and accept the Stripe Connected Account Agreement. Stripe verifies the seller and pays sales out to their bank account on its own schedule. Refunds and chargebacks are handled on the seller's Stripe account.

5. Buyers

Buyers receive a download link by email. Links expire after 48 hours (a new one can be requested) and allow 5 downloads unless the product says otherwise. [FILL IN: withdrawal right for digital content (§ 356 Abs. 5 BGB): buyers agree that delivery starts immediately and acknowledge losing the right of withdrawal.]

6. Takedown

Rights holders can report infringing content at /report. We review reports and remove content where appropriate.

7. Liability

[FILL IN: limitation of liability per German law.]

8. Law

[FILL IN: governing law and place of jurisdiction.]
